Please Hold in The Light

At least 25 killed in Belgian train accident this morning. No official cause for the accident has yet been given, but it is believed to have been caused when one train ran a red light and track change, and rear-ended another train using the track.

Overly Subjective

I'm not quite sure how figure skating is scored in the Olympics. I was caught up by the love story of Shen Xue and Zhao Hongbo, the Chinese pair. They ended with a record breaking score of 76.66 and I was certainly happy for them. I'm torn though, I feel that the Amanda Evora and Mark Ladwig had a truly outstanding performance with such grace, flawless synchronization, and most of all, an apparent energy that radiated. They not only had fun on the ice, but they did so beautifully. I am disappointed by their score of 57.86. I think they deserved better. I hereby step of my soapbox.

Valentine's Day sucks. It should be renamed 'Single Awareness Day'.
Everyone looks so cute holding hands and leaning on shoulders. And then there's me.

Technical Difficulties

Time to pull out the snow machines. Seems Mother Nature is having some technical difficulty in producing proper weather for Vancouver's Olympic events. Apparently numerous events have been postponed for the time being.

P.S. I am rather undecided on this whole global warming thing, but I do want to draw attention to the fact that Fox News was attempting to mock the theory by taking a picture of An Inconvenient Truth in the east coast snow storm. So ummm, yeah...

Sat in one room for a total of 8(?) hours today. Doing nothing. I'm on the Mock Trial Retreat and we were running through the case. All parts EXCEPT the closing. (AKA all parts except mine.) Its alright though, there was good pizza.

Does Not Go To Prove The Truth Of The Matter Asserted.

A statement is hearsay only if it is offered in evidence to prove that the fact asserted is true. If it is offered for some otherrelevant purpose, it is not hearsay. It is the obligation of the respondent to convince the judge that there is a relevant purpose for the statement other than as proof of the fact asserted. Common examples are:
(a) Notice. In a slip-and-fall tort case, a witness testifies that the week before plaintiff's accident, Mary told the defendant that his parking lot was slippery. The primary relevance of the evidence is to show that the defendant had notice of the dangerous condition, not to prove that the lot was slippery a week before the accident.
(b) State of mind of listener. The defendant is charged with knowing use of stolen credit card. He testifies that a friend told him "This is my card and you may use it." The evidence is offered to prove the defendant's state of mind (lack of mens rea), not that the card really belonged to the friend.
(c) State of mind of the speaker. In a will contest, the administrator offers evidence that the decedent said "I hate my youngest son who has become a drug addict." The evidence is offered to show the state of mind of the decedent and explain why he cut the son out of his will, not to prove that the son is really a drug addict.
(d) The statement motivates conduct. In a tort case, the defendant testifies that he was speeding because he had gotten a telephone call from the hospital informing him that his son was in the emergency room. Note that accusatory statements made by witnesses to the police ("the defendant did it") offered to show why the police investigated the defendant are non-hearsay only if there is some genuine issue concerning why the police investigated him.
(e) The statement motivates another statement. In conversations between two people when we are interested in what one of them says, the statements by the other are not offered for their truth but to give meaning to the primary person's remarks. For example, in a police interrogation, when the Detective says "We know you drove the getaway car," it is not being offered to prove the defendant did the crime, but to explain why the defendant said "Yeah I was driving. What kind of deal can I get."

Priorities

You know that feeling that there is something more important that you should be doing?

Well I have a closing statement to announce, a pretty important science test on my first day back, alot of science homework (ALOT), makeup math + current math homework, oh yeah, and a spanish oral to study for. And what am I doing? Exploring Reddit, creeping Facebook, messing on Flickr, playing with my blog. I guess you know the feeling too. There's definitely something you should be doing right now, but instead, you're on my blog.
